1. Definitions
Defines: Digital Content, Licence, Permitted Use, Prohibited Use, DRM, Device, Access Token, User Account, Territory, and Termination Event.
2. Purpose & Scope of this EULA
This EULA governs personal access to and use of all downloaded or streamed digital books, e-books, PDFs, and accompanying files supplied through the bookstore. It supplements the E-Commerce Terms and Digital Downloads Terms.
3. Grant of Licence
A non-exclusive, non-transferable, revocable, worldwide licence is granted solely for personal, non-commercial use. No ownership of the Digital Content is transferred to the User.
4. Ownership & Intellectual Property
All intellectual property rights in the Digital Content remain with Strategic Global Holdings Pty Ltd. Superspeed.ai Pty Ltd acts under licence. Copyright, moral rights, and related rights are expressly reserved.
5. Permitted Use
Users may:
- Download Digital Content for private reading or study
- Maintain one lawful backup copy where permitted
- Access Digital Content across their personal devices
All use must remain within the bounds of this EULA.
6. Prohibited Use
Users must not:
- Share, resell, rent, lend, or otherwise distribute Digital Content
- Remove DRM, watermarks, licensing metadata, or security features
- Upload Digital Content to online platforms or cloud-sharing services
- Modify, translate, adapt, or create derivative works
- Use Digital Content to train machine learning or AI models
- Circumvent geographic, download, or device restrictions
7. DRM, Security & Technical Protections
Digital Content may include DRM, watermarking, encryption, or access tokens. Attempts to bypass, reverse engineer, or tamper with these protections constitute a breach of this EULA.
8. Device Compatibility & User Responsibilities
The User is responsible for ensuring their device supports the required file types and DRM controls. No refunds apply for incompatibility unless required by law.
9. Termination of Licence
The licence terminates automatically if the User breaches any part of this EULA or the Digital Downloads Terms. Upon termination, the User must permanently delete all copies and cease all use of the Digital Content.
10. Post-Termination Obligations
Users must:
- Delete all copies from all devices
- Destroy any backup copies
- Not attempt re-access using alternative accounts
11. Region-Specific Rights
Region-specific consumer rights apply:
- AU: ACL statutory guarantees
- EU/UK: limited cooling-off rights (waived upon download)
- US: state consumer protection statutes
Nothing in this EULA excludes rights that cannot be waived.
12. Liability & Disclaimers
Digital Content is provided “as is” except where prohibited. To the extent permitted by law, liability is limited to replacement, re-delivery, or refund as required by applicable consumer laws.
13. Governing Law
This EULA is governed by the laws of Queensland, Australia, subject to mandatory consumer protections in the User’s region.
14. Cross-Document Hierarchy
This EULA must be read alongside the E-Commerce Terms, Digital Downloads Terms, Refunds & Returns Policy, and Global Privacy Policy. In the event of conflict, mandatory consumer laws prevail.
